How Do I Request Legal Records for Myself or Someone Else?

There may come a time when you decide to file a lawsuit or an insurance claim against another party because of an injury or medical condition. Your attorney will need to request your medical records from Blue Cross Blue Shield of Michigan using a subpoena.

What is a subpoena?

A subpoena is a written document from the court authorizing us to release your medical records to your lawyer.  

Do you have a subpoena?

If we aren’t involved in the lawsuit, a valid subpoena needs to be issued by your lawyer and sent directly to us.

Subpoenas issued by a Michigan court should include:

  • Customer, doctor, health care provider, employee or other individual name
  • Contract or subscriber ID, also called enrollee ID, number
  • Time frame
  • Case name and number
  • Appropriate signatures

Pricing and response time

We charge $34, plus 25 cents per page, for each records request. It will take four to six weeks for us to respond to a valid subpoena request once we receive it.
